Terms & conditions for sales

The terms of sale set out here apply to goods supplied by Cenyth Art Showrooms (a trading company of Cenyth Design Limited). In this document Cenyth Art Showrooms will also be referred to as “CAS”,  “we” and “us”. 


Before placing an order please read these terms and conditions, which may be updated from time to time. By purchasing from us you agree to be bound by these terms and conditions.


These terms do not create any rights to any parties other than the purchaser. 

Description of our service

Cenyth Art showrooms provides a platform for Artists to show and sell their work. Originals are normally shipped by the artist; prints and other items are prepared and shipped by CAS. Artwork is printed on various high quality papers using archival quality inks (Giclée prints).


Artwork appreciation is subjective and whilst we may from time to time give or infer opinion on this site we disclaim absolutely the consequences of an incorrect purchasing decision based on any information or opinion on this site. 


We make great efforts to colour match our prints ti the original artwork. Please note when ordering that colours on a computer screen can be brighter than a printed item, this is because the computer screen emits light and colour whereas the colours perceived from a print are from reflective light.

Intellectual Property Rights, Ownership and Copyright

We respect the intellectual property rights of others and we ask those using this site to do likewise.


Cenyth Art Showrooms are the owner of all intellectual property rights of information, data and pictures in/on the Site, and all material published on it. All images contained on the website are copyrighted property of their respective original artist and are protected by copyright laws and treaties around the world.  You may not publish or submit for publication or reproduction any images on the site to any third party, including the internet, for any purpose. You must not use any part of the materials on our site for commercial purposes. All rights are reserved. 


Once an original, print or other product is in your possession you may not publish or submit for publication or reproduction any image of the edition to any third party, including the internet, for any purpose. You must not use any part of the edition for commercial purposes.


If you breach these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Orders and Prices

Cenyth Art Showrooms use PayPal as their secure online purchasing system. This enables secure payment by any of the debit or credit cards shown as acceptable on the website at time of purchase, and by Paypal. Paypal is used to protect your information, CAS is not involved in the security details of this transaction process and therefore is not liable for any unauthorised access to information supplied by you.


All prices are shown in UK pounds sterling and are inclusive of delivery to UK mainland addresses. (see deliveries / international deliveries below)


After ordering you will receive an email receipt from Paypal to confirm that Cenyth Art Showrooms (CAS) has received your order. Should you not receive an email please contact CAS.


The description and price of goods will be as shown on the website at the time you place your order. Every effort will be made to ensure that prices shown on the website are accurate at the time of purchase. If an error is discovered prior to despatch of your order Cenyth Art Showrooms will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order.


We reserve the right to refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. In such case no explanation needs to be given. We will not be liable to you or any third party by reason of so refusing or by reason of unwinding or suspending any transaction after processing has begun.

Delivery arrangements in the UK

Your shopping basket on the Site displays the goods you have chosen.  Postage and Packing charges in the UK are included in the price.  Delivery times quoted are estimates only, based on availability and normal delivery time in working days.


Goods ordered will be delivered to the address given when the order was placed unless otherwise arranged with CAS.


All CAS products will be sent to you by either Royal Mail or a Courier Service and will require signature on delivery. CAS will endeavour to deliver within 14 days of receipt of payment unless otherwise stated on the website, or advised by email from CAS. 


Signature at the delivery address for any order will act as proof that the order has been delivered to you.


If there is no one available at the delivery address to accept delivery of couriered goods, the courier will notify you of an alternative delivery date or a place to collect the goods.


Once an artwork is considered delivered, responsibility for the edition, risk of damage or loss will pass to you and you shall be responsible for the work. CAS is not liable for any damage which occurs to an order after a delivery has been made.


Artwork is printed to order, as such there may be a delay in production for reasons outside of our control. We will advise you of any conditions we are aware of which may cause undue delay to the delivery of your art work. Late delivery should be within 21 days of order. Delays beyond this time will be followed up closely by CAS and you will be informed and kept up-to-date. 


If CAS are unable to deliver your order within 28 days you will be informed as soon as possible and be entitled to cancel the order and obtain a full refund that will be returned through the method used for payment. 


CAS is not liable for any loss or damage suffered by you through any delay in delivery of an order.

Delivery Arrangements - non UK

Currently International Delivery Charges are not automated or shown on the website. Please contact Cenyth Art Showrooms for international postage charges.


EXPORTED GOODS import duties:

If you order goods from our Site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.


Please also note that products offered for sale are directed solely at UK residents. We make no representation that any products sold through this website are appropriate or available for use outside of the UK. You must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

Returns

We offer a refund to customers if you tell us you wish to return the items within 14 days of receipt. You then have another 14 days to return the goods & will be refunded within 14 days of receiving the goods back. 


You are liable to pay the return postage (we advise a secure postage method with a record of delivery - this ensures we do receive the returned item and that you have a record that it has been received by us). CAS accepts no responsibility for returned goods damaged or lost in transit.

Privacy Statement

We will receive from Paypal your delivery address and the details of your order. Your delivery address and any other personal information will remain private and will not be disclosed to any third parties. email back-ups are held on hard drives on site and are not stored in any cloud storage. Accessing our site

Access to the Site is permitted on a temporary basis

We reserve the right to withdraw or amend the service without notice.

We will not be liable if the Site is unavailable at any time.

Any personal data and other information provided by you is processed by us in accordance with our Privacy Policy. By providing any such personal data or other information you agree to the terms of our Privacy Policy.

Currently you do not need to register with us to make a purchase, we may change this in the future so that you need to register to make a purchase.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party.

We may restrict access to some parts of the Site to registered users.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms & Conditions.


Links

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.


Our Site must not be framed on any other website, nor may you create a link to any part of our Site other than the home page*. We reserve the right to withdraw linking permission without notice.


The Site may provide links to other websites for your information. We have no control over such sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.


(*Artists who sell using the site may have separate agreements with us to allow them to link to their sections of the site and to individual pictures/ web pages)


Viruses, hacking and other offences

You must not misuse our site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of-service attack.


By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.


We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any material posted on it, or on any website linked to it.

Waiver

If we fail at any time to insist upon strict performance of any of your obligations under these Terms & Conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under them, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.


A waiver by us of any default shall not constitute a waiver of any subsequent default.

No waiver by us of any of these Terms & Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

Severability

If any of these Terms & Conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Force majeur

Where we or a supplier to us is prevented from or delayed in the carrying on of its business due to circumstances beyond its reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to the Suppliers workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials the date of delivery shall be postponed for the period that the circumstances continue. We will however make every endeavour to find alternative sourcing. Where possible we will inform you of the postponement time and given options to wait, cancel or adjust your order.

Law and jurisdiction

Contracts for the purchase of Goods through our site will be governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Entire agreement

These Terms & Conditions and any document expressly referred to in them represent the entire agreement between us and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
